DOC National Fair Dealing Road Show Announces Dates

Congratulations to everyone on the FlashPoint team for the U.S. syndication deal. FlashPoint is the uncontested favourite crime drama in our house, and apparently there is more news coming soon from the producers. Yesterday there was a teaser put out on Twitter that this news is something Canucks fans will like.

Documentary Organization of CanadaThe Documentary Organization of Canada is taking its National Fair Dealing Road Show again in 2011. The first stop is coming up in Toronto in January, followed by Ottawa in February, Edmonton and Vancouver in March. The cross-Canada event is a comprehensive effort to educate the documentary community, foster dialogue and identify common positions, or points of contention, around the issue of Fair Dealing and documentary filmmaking.

A little known exclusion to the Copyright Act, Fair Dealing allows for free use of otherwise copyrighted material under certain conditions. For example, some visual archives in a documentary with clear critical purposes could possibly invoke the Fair Dealing exclusion and be exempt from having to obtain clearances.

But how many of us know or understand this finer point of law and when to apply it? More often than not, producers are counseled by their risk-averse lawyers, sometimes at great and unnecessary cost to their clients, to “clear everything all the time.” This can be so costly as to inhibit the production or release of certain documentary films altogether. Whether filmmakers, producers, lawyers or insurance brokers, Fair Dealing and its advantages remain obscure to many of us and underutilized in general.

The National Fair Dealing Road Show aims to introduce potential users to DOC?s Copyright and Fair Dealing – Guidelines for Documentary Filmmakers (PDF), published in May 2010. Filmmakers are encouraged to share their experiences with copyright and to engage on case studies presented for discussion. Lawyers, visual researchers, insurance brokers and broadcasters are invited to take part in the conversation. This is an exercise in building community-based consensus on best practices where panelists and members of the audience discuss copyright myths and argue whether a particular use of copyrightprotected material would meet the Fair Dealing exclusion or not.

Given that copyright law is a federal responsibility, it is necessary to cast this as a national event to gather as many views as possible and present the federal government with a nation-wide consensus, where possible. It is DOC’s experience that the realities of production vary greatly from region to region yet the benefits to the industry from this initiative will accrue nation-wide.

The Road Show plans the following pit stops where local and invited experts will lead panel discussions:

destiny mediaVancouver’s Destiny Media Technologies, Inc., developer of the Play MPEÂŽ system has released an update in its lawsuit against Toronto-based Yangaroo, John Heaven and Clifford Hunt filed May 4, 2007. Destiny had claimed CDN$25,000,000 in damages for defamation and injurious falsehood, breaches of the Trademarks Act and Competition Act, and interfering with Destiny’s economic interests. Yangaroo had filed a counterclaim with similar allegations against Destiny Media and Destiny’s CEO, Steve Vestergaard.

Destiny filed a motion to have the counterclaim dismissed in its entirety as frivolous and the motion was heard in court on October 28th, 2010. On Jan. 20, 2011, Mr. Justice Stanley Kershman announced his verdict. Summary judgment was granted in favour of Destiny in respect of the torts of injurious falsehood and interference with economic relations. Additionally, summary judgment was granted in respect of all claims brought against Mr. Vestergaard in his personal capacity.

The judge also added that, in his view, many of the statements made by Destiny that Yangaroo counterclaimed for were clearly either not defamatory or were justified based upon the evidence filed in the motion. He names a number of statements in his ruling that cannot be fairly characterized as “false or misleading” citing statements that Destiny’s system predates Yangaroo’s patent and that MPE does not have the essential features necessary to infringe on Yangaroo’s patent.

Destiny CEO, Steve Vestergaard reflects on the lawsuit win, “We are pleased that after looking at the evidence, the judge was able to dismiss so much of Yangaroo’s counterclaim. This is the second major decision in our favor in our ongoing dispute with this regional competitor. In June 2010, Destiny successfully won a fast track motion to dismiss a frivolous patent infringement case.”

Destiny’s $25 million claim against Yangaroo remains unchanged and will proceed to trial.

Six Canadian Game Franchises Receive Interactive Achievement Award Nominations

marblemediamarblemedia interactive and Teletoon have flipped the On skatoonyswitch for Skatoony’s web page, which is filled with games, show information, downloadable craft projects and videos. Skatoony is a combined live action and animation quiz show for kids. Each week the two hosts, Chudd Chudders and The Earl pit 3 animated characters against real kids who hope to survive the show’s shenanigans, temperamental producer and environmental challenges to be declared victorious.

aiasSeveral Canadian titles have been named as finalists for the AIAS Interactive Achievement Awards which will be presented at DICE Las Vegas this coming February 10th. The dev teams from EA Canada will be competing against each other in the Sports Game of the Year category with both FIFA Soccer 11 and NHL 11 receiving nominations. The debut title for United Front Games, ModNation Racers, has been named to the Racing Game of the Year category.

Relic Entertainment’s Dawn of War 2: Chaos Rising has been nominated in the Strategy Game of the Year category, while Ubisoft Montreal action title Tom Clancy’s Splinter Cell: Conviction is competing in the Achievements in Animation category. Bioware has been named to the Outstanding Character Performance category for Mass Effect 2 – Male Shepard, while Mass Effect 2 was given the nod for both the Outstanding Achievement in Story,  Role-Playing/Massively Multiplayer Game of the Year and Game of the Year categories.

Assassin’s Creed: Brotherhood has been nominated for an Outstanding Achievement in Original Music Composition Award as well as Adventure Game of the Year and Outstanding Achievement in Online Game Play. The Ubisoft Montreal blockbuster will also be going head to head with Bioware’s blockbuster Mass Effect 2 as they compete in the  Outstanding Achievement in Game Direction category. krangGAMESVancouver Film School graduate Nicholas Yonge has officially launched his indie game development studio krangGAMES, which will initially be focusing on flash games with an eye to expanding its products to other platforms in the future. The studio is currently developing DotGuy vs The Galaxy, which is an action-puzzle game where the player must successfully guide DotGuy out of a damaged spaceship. According to the game’s description, DotGuy vs The Galaxy will feature a campaign mode, unlockable modes of play, multiple playable characters, and user-made content via the Assembly Level Editor. krangGAMES also developed a game named Prior, which was created for the Ludum Dare Competition #19. Prior is a msyterious 2D platformer that was built in Adobe Flash, and in following with the LD19 theme of Discovery, players must navigate through a dark facility in an effort to figure out who they are, what has happened, where they are, and why they are there, developing their story piece by piece.

Hothead GamesHothead Games has brought Swarm creator, Dr. Mike Hayward, out of his dark and windowless office for a few short minutes to explain how players can control their “Swarm” in this first edition of “Ask Dr. Mike.”

Since Dr. Mike tends to speak in programming code without even realizing it, Hothead brought in “man of the people” and “regular guy”, Lead Designer, Pete Low, to bridge the gap and explain to us laypeople the unique and fun way to control your Swarm. Swarm is the upcoming and ultra addictive action game from UTV Ignition and Hothead Games set to release early this year. Dr. Mike did his PhD research in the field of artificial intelligence, and while his research didn’t directly relate to causing the horrific deaths of little cute and pudgy blue creatures, he has harnessed his work to realize that vision in Swarm. In the newly released video, Dr. Mike shows us everything from how to jump, group up, huddle and even stack and bash your Swarmites.

New Opportunites From Ideas to Classics Open To Canadians

This part-time academic program will deliver targeted business-skills training to video game and digital media entrepreneurs. It will pilot in the spring with a full launch in the fall of 2011.

The goal of EDGE is to help grow the interactive digital media industry by providing in-depth business knowledge to video game entrepreneurs. Ontario Heritage TrustWhen Doris McCarthy passed away on November 25th 2010, Canada lost a revered and talented artist, best known for her landscape paintings. Fool’s Paradise, the Scarborough property where she lived and worked, will remain a part of her remarkable legacy. In 1998, McCarthy generously donated it to the Ontario Heritage Trust to become a retreat for future generations of artists. The Trust will post more about the retreat later this year as more information becomes available.

“My colleagues at the Ontario Heritage Trust and I were deeply saddened by the loss of Doris McCarthy. Her unique brand of talent and enthusiasm will be missed,” said Dr. Thomas H.B. Symons, Chairman of the Ontario Heritage Trust. “We are thankful for the memories of Doris that will live on. In 1939, McCarthy bought a picturesque 12-acre (4.9-hectare) property on the Scarborough Bluffs overlooking Lake Ontario. Her mother viewed the purchase as an extravagance, referring to “that fool’s paradise of yours.” The name Fool’s Paradise stuck and she eventually made it her full-time home.

In addition to its significance by association with McCarthy, Fool’s Paradise is also an important natural heritage site. The property is perched on a narrow plateau of the ecologically sensitive and geologically significant Scarborough Bluffs. In 1986, to help conserve the site, McCarthy donated seven acres (2.8 hectares) to the Metropolitan Toronto Region Conservation Authority under an Erosion Control Agreement.

In 1998, McCarthy donated the remainder of Fool’s Paradise to the Ontario Heritage Trust, along with a charitable remainder trust to maintain the property in perpetuity. She retained a life tenancy, with the intent that after her death it would become a retreat for artists, musicians and writers, and a setting for heritage activities. In the coming year, the Trust will be working to plan the retreat McCarthy envisioned – giving other artists the opportunity to be inspired by the beauty of Fool’s Paradise, just as she was herself.Montreal Museums App

CMPAThe Canadian Media Production Assocation (CMPA) has released Profile 2010, its annual economic report on the Screen-Based Production Industry in Canada, which showed limited growth from 2008/09 to 2009/10, with an overall increase in production volume from $4.8 billion to $4.9 billion.

Profile is an annual economic report published by the Canadian Media Production Association (CMPA) in collaboration with the Association des producteurs de films et de tĂŠlĂŠvision du QuĂŠbec (APFTQ), and the Departmentprofile 2010 of Canadian Heritage. The report provides a statistical overview of the three main screen-based production sectors in Canada: Canadian production (includes television and theatrical), foreign location & service production, and broadcaster in-house production. These sectors helped sustain 117,000 full-time jobs in 2009-2010.

Total numbers for independent television production were down by 3.4%, despite an overall one per cent rise in activity in the industry. The 7.8% decrease in English-language production levels largely contributed to the lower television values. The report also reveals that while Canadian theatrical production and foreign location & service production regained some momentum in 2009-2010, both production segments are below peak levels reached in the last 10 years.

Teradici PCoIP protocol is an innovative remote display technology that allows the user’s desktop operating system, applications, and data to reside in the datacenter, eliminating the need for traditional desktop workstations, PCs and thin clients, and delivers an uncompromised user experience to each person, anywhere, without incurring the security risks associated with having data reside in remote PCs. PCoIP technology provides high resolution, full frame rate 3D graphics and high-definition media, with full USB peripheral interoperability, locally over a LAN or remotely over a high-latency WAN. It compresses, encrypts and encodes the entire computing experience at the datacenter and transmits it ‘pixels only’ across a standard IP network to secure, stateless PCoIP zero clients, thin clients, and mobile devices.

The protocol is implemented in silicon for hardware accelerated performance and enhanced security, as well as in several software configurations, including VMware View™, the industry leading desktop virtualization platform. A growing ecosystem of over 25 third-party vendors provide a wide variety of PCoIP products including server plug-in cards, rack and tower workstations, blade PCs, zero clients, integrated monitors, and IP phones with added PCoIP capability.

CMPAThe Canadian Media Production Association has filed an intervention (PDF) with the CRTC, confirming that it does not support BCE Inc.’s application as filed, to acquire sole control of CTVglobemedia Inc. The CMPA disagrees with BCE’s contention that tangible benefits are not payable as a result of this transaction. The CMPA similarly disagrees with BCE’s proposal that the valuation of benefits payable amounts to only $221 million and that a mere $40 million of that amount will go towards supporting the creation of Canadian programming. The CMPA expects to make its arguments before the CRTC when it commences hearings into the proposed acquisition on February 1, 2011.

“The benefits package proposed by BCE represents a very significant departure from the CRTC’s long-standing tangible benefits policy. It is also extremely self-serving and very largely focused on activities that are normal capital expenditures for such a company,” says Norm Bolen, the CMPA’s President and CEO.

In its intervention, the CMPA argues that the tangible benefits policy must be respected. This means that:

* the payment of tangible benefits are indeed fully required in this transaction;
* the quantum of these TV benefits must represent 10% of the total value of all CTV television assets;
* BCE must not be allowed to exclude or discount any of its television-related assets in this calculation;
* a minimum of 85% of the total tangible benefits must be allocated to the creation of Canadian programming;
* a minimum of 75% of the amount allocated to the creation of Canadian programming must be earmarked to third-parties from the independent production community; and,
* the resources allocated to the creation of independent Canadian programming must be administered by a third-party, and must not be limited to projects that are ultimately broadcast only on CTV or its many television properties.

“If BCE’s proposal is accepted by the Commission without considerable modifications it would fall extremely short of what is in the best interest of our broadcasting system and the Canadian public,” says Bolen.

Ontario Libraries Connect Users To Knowledge

Since January 2008, many Ontario libraries have been collaborating to provide an online inquiry service askONcalled askON, along with a similar French-language service called ONdemande. askON and ONdemande are among the five digital services of Knowledge Ontario, a not-for-profit collaborative. Seven more public libraries joined the service on January 3, so a total of 63 libraries across the province are now participating.

Here’s how it works. You go to your local library’s website or to the askON home page and open a live chat session. After you post your question, a real librarian—not an automated search engine—finds the information you need. The service is available 45 hours a week, and most inquiries take about 10 to 15 minutes to answer.

Each library provides two to eight hours of live chat help each week. askON is the sort of service very few libraries could provide on their own. However, it’s exactly the sort of service they need to offer to stay relevant to many of their users.

“Providing wider access to library services is a key priority for us,” says Matyas. She points out that technologically savvy users have flocked to askON. “The uptake has been tremendous in our community.”

askON has been particularly popular with students and businesspeople—two groups who might not naturally visit a brick-and-mortar library but who spend a great deal of time online. “We’re actually going where they are,” says Laura Master, co-ordinator of information services at the Kitchener Public Library. “It’s one more avenue for people to explore and discover our libraries.”

Once users have made that initial contact, librarians can use the opportunity to help them increase their digital literacy. Many Ontarians, for instance, don’t realize that their library cards give them access to a wealth of authoritative databases that can take them far beyond what a simple Google search can offer. In an online chat, librarians can help clients access and navigate these databases. Librarians are unabashed fans of the service, which helps them develop their technical skills and gives them an opportunity to do what they do best: find information.

To play Burn the Rope you have to tilt and turn your phone to keep your flame alive, but there’s a catch… the fire only burns upwards! It’s your job to try to burn as much rope as you can in each level so you can collect Bronze, Silver, or Gold medals!

As you progress through the levels, you’ll encounter bugs crawling along the rope. Different bugs have different reactions to the flame. For example, the ant changes the color of the flame so you can access and burn different colored ropes, and the spider shoots out a web bridge so you can access parts of the level that you could not before. You will actually feel like you’re burning a rope, yet there’s no need for a fire extinguisher!

Based on its huge popularity with reviewers and fans alike, it’s easy to see that Burn the Rope is going to be sitting at the top of charts for quite a while. Big Blue Bubble Inc. is pleased to see that an Ontario company can make such a huge impact in the US App market, as well as those from around the world.

One Canadian title has been named to the IGF Student Game Showcase, and one received an Honourable Mention. First-person puzzler FRACT, developed by University of Montreal student Richard Flanagan, puts the player into an abstract world built on sound and structures inspired by electronic music. The player must then resurrect and revive the long forgotten machinery of this musical world, thereby unlocking the mysteries contained within.

Honourable Mention was given to Star-Twine, a title developed at Carleton University. According to the game’s description, “Star-Twine is a strategy game with ambient sounds, unique visuals and a virtually infinite number of levels to play on. Battles take place on three dimensional maps where you, a small point of light, must build structures to extract energy from the threads that make up the world. Energy can be spent on new structures, each with their own unique abilities. The enemy AI builds while you build and reacts to your play-style. This results in challenging battles that require strategic insight and quick thinking.
